Legal Information

Terms & Conditions

Please read the following carefully. These terms govern how our website may be used and the basis on which we engage clients for legal services.

Last updated: 15 April 2025

1. Acceptance of These Terms

By accessing or using this website, you acknowledge that you have read and understood these Terms & Conditions and agree to be bound by them. If you do not agree with any part of these terms, we ask that you refrain from using this website.

These terms apply to all visitors, whether or not you choose to engage us for legal services. Using any part of the website, including submitting an enquiry form, constitutes acceptance.

2. Use of This Website

You may use this website for lawful purposes and in a manner consistent with its intended function — to learn about Amanah Legal's services and to make enquiries. The following are not permitted:

  • Using this website in any way that violates applicable Malaysian law or regulation
  • Transmitting unsolicited or unauthorised commercial communications
  • Attempting to gain unauthorised access to any part of this website or its related systems
  • Distributing malicious software or code through or to this website
  • Collecting or harvesting any personal data from this website without consent

We reserve the right to restrict or terminate access to this website at our discretion, without prior notice, if we reasonably believe these conditions have not been observed.

3. Information Purposes Only

All content on this website — including descriptions of services, general explanations of Malaysian family law, and information about our practice — is provided for general informational purposes only.

Nothing on this website constitutes legal advice, nor does it create a solicitor-client relationship. Legal advice is personal to individual circumstances and can only be given once we have formally accepted you as a client and conducted a proper assessment of your matter.

We make reasonable efforts to keep the information on this website current and accurate, but we do not represent that it is free from error or reflects the most recent legal developments. You should not act or refrain from acting on the basis of anything on this website without first seeking specific legal advice.

4. Engaging Our Services

A formal professional relationship with Amanah Legal is established only when both parties have signed a written engagement letter and the applicable terms of that letter have been agreed. Submitting an enquiry through our website, sending an email, or attending a consultation does not, by itself, create a solicitor-client relationship.

We are obliged under the Legal Profession Act 1976 and applicable Bar Council rules to carry out conflict-of-interest checks before accepting instructions. We will let you know promptly if we are unable to act for you.

We reserve the right to decline to act in any matter, without being required to provide reasons.

5. Fees and Payment

The fees displayed on this website represent our current standard charges for defined service packages as at the date of last update. All amounts are stated in Malaysian Ringgit (RM) and are exclusive of any disbursements, court filing fees, or other out-of-pocket expenses unless specifically stated.

Displayed fees may differ from the fees applicable to your specific matter, which will be confirmed in your engagement letter. Fees are subject to revision without prior notice on the website; however, any agreed fee in a signed engagement letter will remain binding for that engagement.

Payment terms are as set out in the relevant engagement letter. We do not retain funds on account other than in accordance with Bar Council Solicitors' Accounts Rules.

6. Confidentiality

We treat all information shared with us — whether before, during, or after formal engagement — with discretion. Any information you provide in an enquiry or consultation will be held in confidence and not disclosed to third parties except as required by law, with your consent, or where necessary to carry out your instructions.

Please note that communications sent via standard email or web forms are not inherently secure. If your matter is sensitive, we welcome a direct telephone call to +60 3 2148 7392 to arrange more secure communication.

7. Intellectual Property

All content on this website — including text, layout, design, graphics, and branding — is the intellectual property of Amanah Legal or its licensors and is protected under Malaysian copyright law and related legislation.

You may view and print pages from this website for your personal, non-commercial reference. Reproduction, redistribution, or adaptation of any part of this website for commercial purposes, or without attribution, is not permitted without our express written consent.

8. Third-Party Links

This website may contain links to external websites operated by third parties, including government portals and court-related resources. These links are provided for convenience only. We have no control over the content or availability of linked sites and do not accept any responsibility for them or for any loss or damage that may arise from your use of those sites.

The inclusion of a link does not imply endorsement of the linked site or its operator.

9. Limitation of Liability

To the extent permitted by Malaysian law, Amanah Legal shall not be liable for any direct, indirect, incidental, or consequential loss arising from:

  • Your use of, or inability to use, this website
  • Reliance on any information contained on this website without seeking independent legal advice
  • Any interruption, suspension, or termination of website access
  • Any errors or omissions in the content of this website

Nothing in these terms limits or excludes liability for fraud, personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

Our professional liability as legal practitioners is governed by the Legal Profession Act 1976 and the applicable terms of our engagement letters. Any claim relating to legal services must be raised with us directly in the first instance.

11. Governing Law

12. Amendments to These Terms
